What’s different about a pool inside the City of Houston
- Two reviews, one portal. Your builder applies through the city’s iPermits system. The Health Department’s residential pool plan review costs $94.00 plus a $33.56 admin fee ($127.56 total) and takes 10 business days to process.[1]
- A deed restrictions declaration is part of the application. The city asks for a signed declaration (form CE-1380 for individuals, CE-1381 for business entities) with the residential permit application.[1] That’s one more reason to check your deed restrictions and HOA rules first.
- Self-closing, self-latching gates. Health Department plan requirements cite Chapter 43, Sec. 43-33: gates must be self-closing and self-latching, and driveways or carports can’t be part of the pool enclosure.[2]
- Covered structures get their own permits. Pergolas, pool houses, cabanas and covered outdoor kitchens are permitted separately from the pool. A pool deck and a completely uncovered outdoor kitchen can go under the pool permit.[3]
- Easements and power lines. Pools can’t encroach into utility or aerial easements, and the water surface must stay at least 22.5 ft diagonally or 10 ft horizontally from aerial power lines.[3]
- Posted permit and three inspections. The permit must be paid for before construction and posted facing the street. Inspections are pre-construction, pre-fill (only if fill is brought in) and final.[4]

Questions to ask a Houston pool builder
- Will you file in iPermits and handle the Health Department plan review? Are those fees in your price?
- How will the fence and gate layout meet the self-closing, self-latching rule on my lot?
- Does my survey show utility or aerial easements that limit where the pool can go?
- If I add a covered patio or outdoor kitchen, how will the separate permit affect the schedule?
- What’s the payment schedule, and what does the written warranty cover?
